Welcome to Hakapoké ("we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of the Hakapoké mobile application, website and ordering services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement and that the information you provide is accurate and complete.

2. Your Account

You are responsible for safeguarding your credentials and for any activity under your account. Authentication is provided through our identity partner, Clerk, Inc. You agree to notify us immediately at support@hakapoke.com of any unauthorized use.

3. Orders, Pricing & Payment

All prices are displayed in the local currency and include applicable taxes unless otherwise stated. We may modify menu items, prices or availability at any time. Orders are confirmed only after payment is successfully processed. Estimated delivery and pickup times are not guaranteed.

4. Cancellations & Refunds

You may cancel an order before it enters preparation. Once preparation starts, refunds are at our discretion based on the nature of the issue. If your order is incorrect or unsatisfactory, contact us within 24 hours and we will work to make it right.

5. Food Allergens & Safety

We prepare food in shared kitchens that may contain peanuts, tree nuts, soy, dairy, eggs, fish, shellfish, gluten and sesame. Ingredient information is provided as a courtesy and may change. You are responsible for confirming suitability with our team if you have allergies or dietary restrictions.

6. Loyalty & Rewards

Loyalty points and rewards have no monetary value, cannot be exchanged for cash and may expire or be revoked in cases of fraud or abuse. We may modify or discontinue the rewards program with prior notice in the Service.

7. Acceptable Use

You agree not to:

• use the Service for any unlawful purpose;
• interfere with the security or integrity of the Service;
• attempt to access accounts or data that are not yours;
• resell, scrape or systematically extract content;
• impersonate any person or entity.

8. Intellectual Property

The Service, including the Hakapoké brand, logo, content and software, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.

9. Termination

We may suspend or terminate your account at any time if you breach these Terms or use the Service in a way that harms us or other users. You may delete your account at any time from Profile → Delete Account.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, secure or error-free.

11. Limitation of Liability

To the maximum extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the 30 days preceding the claim, or (b) USD $50.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use of the Service after changes take effect constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which Hakapoké operates, without regard to its conflict of law principles. Disputes will be resolved in the competent courts of that jurisdiction.
